in the tree of fcmp++ is every leaf at the same distance of the root?

root-> select-> v1 -> select and rerandomize -> v2 -> select and rerandomize ... leaf

so all the paths must have the same length or else that would discriminate upon wich leafs, the proof (path of commitments) is not intended for ?
