How does merge mining work if the chain is stateful? Are you receiving transanctions from the mempool of both the chains?

The first question isn't clear to me, but for the second question, yes. Both daemons are running, at least in my case.

I meant that since transactions are usually added to a block before finding the solution, and since a transaction on chain 1 would be invalid on chain 2, how would a solution for chain 1 (other than an empty block) be a solution for chain 2?

you only include the hash of a block in the merge chain in the block of the main chain
